Sift — Terms of Use

1. Acceptance of Terms

By downloading, installing, or using Sift ("the App"), you agree to be bound by these Terms of Use. If you do not agree, do not use the App.

2. Description of Service

Sift is a mobile application that allows users to save video links from social media platforms and generates AI-powered summaries, transcriptions, and organizational tools for personal use.

3. Eligibility

You must be at least 13 years of age to use Sift. By using the App, you represent and warrant that you meet this requirement.

4. User Accounts

Sift uses anonymous device-based identification. No account creation is required. Your device identifier is generated locally and used solely to associate your saved content with your device.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's servers or networks
• Use the App to infringe upon the intellectual property rights of others
• Use automated systems or bots to access the App
• Attempt to gain unauthorized access to other users' data

6. Intellectual Property

The App, including its design, features, and content (excluding user-submitted video URLs and third-party content), is owned by Sift and protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

7. Third-Party Content

Sift processes video content from third-party platforms (Instagram, TikTok, YouTube, etc.). We do not claim ownership of any third-party content. You are responsible for ensuring your use of saved content complies with the respective platform's terms of service.

8. AI-Generated Content

Summaries, transcriptions, and organizational tags are generated using artificial intelligence. While we strive for accuracy, AI-generated content may contain errors or omissions. Sift does not guarantee the accuracy, completeness, or reliability of AI-generated content.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIFT AND ITS DEVELOPERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify and hold harmless Sift and its developers from any claims, damages, losses, or expenses arising out of your use of the App or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. We will update the effective date at the top of this page.

14. Apple-Specific Terms

If you access the App through the Apple App Store, the following additional terms apply:

• These Terms are between you and Sift, not Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims relating to the App, including product liability claims, consumer protection claims, or intellectual property infringement claims.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.
